Trust Administration – Living Trustor(s)
This service involves managing a living trust according to the Terms of Trust as set forth in the trust document, ensuring trustor's instructions are followed during their lifetime, and ensuring assets are handled as intended for their benefit. This includes providing assistance managing day-to-day finances, oversight of accounts to help protect from theft, or fraud, and prudent investing to help produce income and minimize risk.
Trust Administration – Deceased Trustor(s)
This service involves administering a trust according to the Terms of Trust as set forth in the trust document, following the death of the person who created it, including identifying and marshaling all trust and non-trust assets, paying all debts, working with CPA firms to file taxes, and distributing the remaining assets to beneficiaries . We follow all legal and administrative steps necessary to settle the trust efficiently.
Probate Estate Administration
This service manages the legal process of settling a deceased person's estate under probate court supervision, including validating the will (if one exists), inventorying assets, paying debts and taxes, and distributing the remaining property to heirs or beneficiaries.
Power of Attorney for Finances and Healthcare
This service involves acting as a designated agent under a legal Power of Attorney document to make financial and/or healthcare decisions on behalf of another individual. We exercise this authority to manage finances, pay bills, make medical choices, and ensure the individual's well-being according to their wishes and best interests when they are unable to do so themselves.
Advance Healthcare Agent
An Advance Healthcare Agent is appointed by an individual to make medical decisions on their behalf if they become incapacitated and unable to communicate their own healthcare wishes. We serve in this capacity to ensure your healthcare preferences, as outlined in your advance directives or discussed with us, are respected and implemented by medical professionals.
Conservator of the Estate
As Conservator of the Estate, we are legally appointed by a court to manage the financial affairs and assets of an individual who is unable to handle their own finances. Our role is to protect their property, pay their bills, manage investments, and make financial decisions in their best interest under court supervision.
Special Needs Trust Administration
Special Needs Trust Administration involves managing a trust specifically designed to hold assets for the benefit of an individual with a disability while maintaining their eligibility for essential government benefits. We oversee the investment and distribution of trust funds for supplemental needs such as medical care not covered by benefits, education, therapy, and enhancing their quality of life.
Fee Schedule and Billing
OConnor Fiduciary Services, LLC’s current rate for services is $200 per hour, apart from probate administration services whereby the fees are calculated under California Probate Code 10800 are computed on a fee base comprised of gross assets, plus receipt and gains, less losses as follows:
4% of the first $100,000
3% of the next $100,000
2% of the next $800,000
1% of the next $9,000,000
0.5% of the next $15,000,000
Court discretion after $25,000,000
In addition to statutory fees, pursuant to Probate Code 10801, extraordinary fees can be requested for services such as, but not limited to, tax issues, real property sales, and litigation.
Though fees for extraordinary services are subject to court approval, extraordinary services are charged at the hourly rate of $225 - $250 per hour.
All time expended is billed in 15-minute increments. Billing services include phone calls/discussions, text communications, email, meetings (in-person and video), conference calls, research and investigation, analysis, payment of bills, reconciliation of accounts, travel, and any other activity associated with the case.
Direct and out-of-pocket costs and expenses incurred shall be itemized and charged back for reimbursement. This includes postage, delivery fees, court costs, parking, tolls, and any other costs associated with administering the trust/estate.
Professional services such as accounting, tax preparation, investment management, care management, and legal services are contracted with sources outside of OConnor Fiduciary Services, LLC and are paid for with trust/estate funds.
Fees are billed monthly and paid via client funds.
Fees are subject to change with 30 days’ notice.
